Feb 12 Deadline for Spam Text Compensation
A healthcare giant has reached a $10.5 million settlement in a class-action lawsuit. Kaiser Permanente was accused of sending unsolicited, non-emergency text messages to people who had opted out of receiving them.
The legal action claimed these automated messages violated the Telephone Consumer Protection Act (TCPA). This federal law places limits on unsolicited marketing calls and the deployment of automatic dialing systems. (Source: lifehacker.com)
The lawsuit called the messages an "invasion of privacy, harassment, aggravation and disruption of daily life." It said Kaiser had not taken adequate steps to make sure people who'd exercised their opt-out rights were removed from marketing lists.
Who is Eligible for a Payment?
The settlement covers people in the US who received messages from Kaiser between January 21, 2021 and August 20, 2025. Specifically it applies to anyone who got at least one message within 12 months following them sending an opt-out message such as 'STOP'. A message simply acknowledging the opt-out does not count towards the case.
The settlement documents makes clear that Kaiser has not admitted any wrongdoing and that the court does not have rules on whether the allegations against it are true or false. (Source: kaisertcpasettlement.com)
How to File Your Claim
Those who believe they are part of the settlement class can submit a claim online or by mail.
According to the official settlement website, claims must be filed by February 12, 2026 through the kaisertcpasettlement.com website and only if you received a unique login and PIN number through regular snail mail or by email. That said, be VERY CAUTIOUS of clicking any links to supposed settlement websites received by email as they may be fake. Only use the web address kaisertcpasettlement.com to file your claim.
The maximum any individual can received is $75 per message, though this may be lower depending on how many valid claims are received.
What's Your Opinion?
Have you ever received unsolicited text messages after actively opting out? Do you think settlements like this are effective in preventing companies from sending spam texts? Should there be stricter penalties for violating the Telephone Consumer Protection Act?
